2023 ACT 20 Requirements
- Schools must have a policy for promotion from 3rd to 4th grade, based on a DPI model policy, by July 1, 2025. This would go into effect September 1, 2027.
Lena Public Schools Implementation:
- 4th Grade/8th Grade Promotion:
A student shall be promoted from 4th to 5th grade when the student meets the following criteria:
1. the student's score on the 4th grade examination, unless the student has been excused from taking the examination;
2. the student's academic performance;
3. recommendations of teachers, which are based solely on the student's academic performance.
A student shall be promoted from 8th to 9th grade when the student meets the following criteria:
1. the student's score on the 8th grade examination, unless the student has been excused from taking the examination;
2. the student's academic performance;
3. recommendations of teachers, which are based solely on the student's academic performance.
Students that do not meet the above criteria will not be promoted to 5th or 9th grade.
- 3rd Grade/4th Grade Promotion:

A student shall be promoted from 3rd to 4th grade when the student meets the following criteria and there is agreement between the parents/guardians and the school district representatives:

the student’s score on the 3rd grade summative assessment and universal screener
- diagnostic assessments will also be analyzed for grade level skills relevant to the subjects of reading and literacy;
If the student completes their personal reading plan and is proficient in reading and literacy
If promotion to 4th grade (with applicable services/supports) is more appropriate than retention in 3rd grade, the student is promoted;
If parents/guardians and school/district representatives agree that retention (with applicable services/supports) is more appropriate than promotion to 4th grade and the student’s parent or guardian gives written consent to retention;
If the school/district representatives recommend retention but the student’s parent/guardian does not consent to retention. Regardless of any other facts, circumstances, or analysis, the student is promoted to 4th grade.
